Marital Agreements

Clearwater Prenuptial Agreement Lawyer

Many marriages do not work out and it is essential to have an agreement in place for this possibility. But it is just as important to establish what happens to assets when one spouse passes away. The laws of the State of Florida may dictate such distribution otherwise. You may have a verbal agreement or understanding with your spouse that will not be upheld when the time comes.

Estate Planning

Families are more complicated than they once were. You may have children or spousal support obligations from a previous marriage. Let us ensure that your estate is distributed according to your wishes.

Does a prenuptial agreement cast a shadow on the marriage?

A prenuptial agreement is also called an antenuptial agreement, a prenup or a premarital agreement. It sets out what will happen if the marriage should fail. It is not an anticipation that it will fail or a self-fulfilling prophesy. If one person brings more assets into the marriage or has children from a prior marriage who must be cared for, the parties should be mature enough to acknowledge these facts.

If you should get divorced without a prenup in place, the results will be outside your control. Florida law will affect the outcome, as will the presiding judge. Negotiations for settlement may be hard to predict. Many issues can be agreed to in advance and avoided with a prenup.

Our firm can draft an effective agreement that you and your intended can sign, regarding your ownership in your family business, what property would go to whom, even what percentage of the marital estate would go to each. As long as the agreement is not patently unfair or material facts undisclosed, it will be valid and enforceable.

Post-Marital Agreements

If you are married and are interested in a similar, post-marital agreement, this can set things on a more stable and less uncertain foundation, particularly if there has been a significant change or you are considering divorce.

Clearwater post-marital agreement attorney Susan Charles will be happy to discuss the asset protection and other benefits of a post-marital agreement and any related estate planning with you. She is an established and accomplished attorney serving clients in the Clearwater, Florida, area.
